GENERAL TERMS AND CONDITIONS FOR THE CONDUCTION OF TRAINING CLASSES IN THE TRAINING ROOMS OF POLE DANCE BULGARIA

I. TRAINING CLASSES

1.1 The training classes shall be conducted under the guidance and supervision of a coach who shall explain how to perform the exercises and shall monitor their proper and safe performance by every trainee.

1.2 To ensure the trainee’s safety the coach may individually decide to determine the actual level of trainee’s general physical fitness and skills in case the coach finds that it differs from the level declared by the trainee.

1.3 While practicing, the trainees must follow the instructions given by the coach with regard to the technique of exercise performance and all the recommendations concerning the safe conduction of training classes.

1.4 Trainees must inform the coach in advance if they suffer from any diseases of the musculoskeletal system or have any contusions and traumas, heart and vascular diseases, disorders of the respiratory tract, any vestibular disorders, or any other disease or disorder or peculiarity that may be adversely affected by intensive and stressful physical exercise.

1.6 The coach may refuse to give classes to a trainee who was found to be in improper physical or mental condition to attend the training class due to alcohol or drug abuse or due to the effect of any medication, drink or substance on that trainee’s adequate response and ability to judge the surroundings.

1.7 The coach may refuse to give training classes to a trainee who has failed to make one or more due payments.

1.8 The trainees are required to take off any jewelry they may be wearing prior to the start of training class.

1.9 It is not recommended to use any hand or body lotions or creams on the day of training and even less immediately before the start of training class in pole dance and aerial acrobatics.

1.10 Free training - The class is only suitable for advanced level. The elements that are mandatory to join this class are: 
- free practice on pole - Layback, Butterfly and Gemini;
- free hoop training - Scarab, Amazon, Star, controlled climbing on top of the hoop;
- free aerial silks training - climbing and controlled descent, tying a knot in the air. 
Training by trainees without an instructor and the execution of new elements is prohibited. Multisport cards are not valid for this class. 
 

II. TERMS OF PAYMENT

2.1 Payments for the training classes shall be accepted in cash or by automatic marking in the visits subscription card.

2.2 For the training classes accessible through the Multisport cards, entries shall be made by marking on site the class as appropriate immediately before the start of training class.

2.3 The subscription cards are issued personally and can be used only by the title person, letting it to other persons for use is not allowed.

2.4 The purchase of a subscription card for a certain number of training classes is not a guarantee that the trainee shall actually take the classes. Booking a class in terms of making an appointment for the date and time of training class conduction is an obligatory requirement and it can be done in the manner described further below.


III. RULES FOR MAKING AN APPOINTMENT FOR A TRAINING CLASS
3.1 General provisions

3.1.1 Anybody can book a date and time for a training class online by logging into the monthly/ weekly schedule of Pole Dance Bulgaria.
3.1.2 Appointments and cancellations of training classes that should start by 10 a.m. on the next day shall be accepted by no later than 9:00 p.m. on the previous day.

3.1.3 The maximum number of trainees to attend a training class depends on the particular type of training class and the capacity of the training room. When the maximum number for the training class scheduled for a particular date and time has been booked, requests for appointment can only be entered in the waiting list.

3.1.4 Payment for a booked training class shall not be demanded if it is cancelled by deleting the appointment online from the schedule not later than 3 hours prior to the start of training class. In case the appointment is not cancelled within the said deadline, a payment obligation shall be generated and the trainee shall be required to pay for the booked training class regardless of whether or not he/she has attended it.

3.1.5 Appointments for training classes can be made for one month ahead and the new schedule shall open on the 25th day of the preceding month.

3.1.6 Appointments for training classes shall close 3 hours prior to the start of training class.

3.1.7 If the desired training class is fully booked, the trainee may enter the waiting list.

3.1.8 Customers holding Multisport are not required to activate their cards in our appointment system.

3.1.9 The generated payment obligation when the appointment has been cancelled within less than 3 hours prior to the start of training class or non-attendance of a booked class, is payable only in cash by the customers holding Multisport cards.

3.1.10 The Multisport cards cannot cover a generated payment obligation for late cancellations or non-attendance of a training class.

3.1.11 Being late for classes where Multisport cards will be used are hightly undesirable, as ths would interfere with the normal course of the class. According to the rules of Multisport, we have no right to mark the cards after the start of the class. 

3.1.12 In case the customer has one or more overdue payments for late cancellation or non-attendance of a training class, he/she shall not be allowed to book and attend another class until he/she pays those overdue sums within 14 calendar days.

3.2 List of subscribers:

3.2.1 Entry in the List of subscribers shall be effected by booking a training class. Only the persons entered in the List of subscribers may attend the training class.

3.2.2 Removal from the List of subscribers without generating a payment obligation for the booked training class can be made not later than 3 hours prior to the start of booked training class.

3.2.3 Removal from the List of subscribers in less than 3 hours prior to the start of booked training class to the very start of the class or non-attendance of the training class, shall generate a payment obligation for the training class or shall check out a class from the subscription card if the customer has used such to make the booking.

3.3 Waiting list:

3.3.1 In case the List of subscribers is full, the customer may enter the Waiting list. Entry in the Waiting list provides the opportunity for every person to be transferred into the List of subscribers when a vacancy appears. Transfers from the Waiting list to the List of subscribers shall take place in accordance with the order of entry in the Waiting list. Entry in the Waiting list does not allow attendance of a training class.

3.3.2 Removal from the Waiting list for training classes shall not generate a payment obligation and shall not give reason for checking out a class attendance from the subscription card.

3.3.3 Transfers from the Waiting list to the List of subscribers shall be considered completed when the customer receives an e-mail message/push informing him/her that such transfer has taken place.

3.3.4 After the trainee was transferred from the Waiting list to the List of subscribers and an appointment was made, he/she shall be given at least 3 hour in case he/she wants to cancel the appointment without generation of a payment obligation. Failure to make a cancellation within the above-mentioned time or non-attendance of the booked class shall generate a payment obligation for the training class or shall result in checking out one class attendance from the subscription card if the trainee has such.

3.3.5 If a trainee who was transferred from the waiting list to the list of subscribers cancels an appointment in less than 3 hours prior to the start of booked training class or fails to attend it, a payment obligation for the training class shall be generated or one class attendance shall be checked out from the subscription card if the trainee has such.

 


IV. BY BOOKING A TRAINING CLASS THE TRAINEE DECLARES THAT HE/SHE:

4.1 has read and accepted these general terms and conditions for the conduction of training classes in the training rooms of Pole Dance Bulgaria.
4.2 is aware that pole dance, aerial acrobatics, aerial yoga and bungee fitness are sports that involve high risk of trauma and the training classes are associated with specific risks such as body injuries (incl. limb fractures, bruises, grazes, etc.) as a result of slipping, falling down from great height or collision with another trainee while performing the exercises. The above risks depend on a number of factors, among which are the physical capacities, coordination and behavior of the trainees in class, the response time of the medical emergency team, the compliance with safety rules and the use of equipment in accordance with the instructions of Pole Dance Bulgaria.

4.3 knows that diseases of the musculoskeletal system, contusions and traumas, heart and vascular diseases, disorders of the respiratory tract, vestibular disorders, or other diseases may be adversely affected by intensive and stressful physical exercise, thereby causing additional traumas and overall worsening of the person’s health, and undertakes to inform the coach in so many words if he/she suffers from any such disease or disorder.

4.4 knows and acknowledges that even if the exercise performance technique and the coach’ instructions have been strictly followed, pain may be felt in certain muscles or joints, and also incidental traumas may occur that could not have been predicted or prevented by the supervising coaches.

4.5 agrees to strictly follow the coach’ instructions regarding the proper and safe performance of exercises, and consider and comply with the recommended use of weights and number of repetitions.

4.6 knows and acknowledges that any unwarranted action of his/her own, taken despite the coach’ instructions to the contrary, may lead to contusions and traumas, and accepts full responsibility for the consequences.

4.7 knows and acknowledges that he/she shall be liable for all damages caused to other persons or things as a result of his/her actions taken in violation of the internal rules of the training room or contrary to the coach’ instructions.

4.8 has been informed that nobody else but he/she shall be responsible for any stolen, forgotten or lost personal belongings.
